Untoward injuries are unacceptably common in medical treatment, at times with tragic consequences for patients. The phrases 'an epidemic of error' and 'the medical toll' have been coined to describe this problem of 'iatrogenic harm', which it has been suggested may have contributed to 98,000 deaths per year in the US. Some of these incidents are the result of negligence on the part of doctors, but more usually they are no more than inevitable concomitants of the complexity of modern healthcare. (...) Although medicine is used as the book's primary example, the points made apply equally to aviation, industrial activities, and many other fields of human endeavour. There can be no disputing the proposition that doctors and nurses should be held accountable for their professional activities. In most circumstances this accountability should be achieved through appropriate and effective complaints and disciplinary procedures, but there will be cases where the criminal law should become involved. The criminal law, however, is a serious weapon, and should only be used to punish those whose conduct is truly criminal; it should not be used against those who have merely made a human (...) error. The task of the law should therefore be to identify those situations where a doctor or nurse has behaved in a way which demonstrates a criminally culpable state of mind. The book provides a novel theory of the criminal law that focuses, not on when it is appropriate to blame and make suffer an individual character, but on when it is legitimate to deprive a free agent of its liberty and on how it is possible to reconcile punishment with individual freedom.

This chapter is a philosophical survey of some leading approaches in formal epistemology in the so-called ‘Bayesian’ tradition. According to them, a rational agent’s degrees of belief—credences—at a time are representable with probability functions. We also canvas various further putative ‘synchronic’ rationality norms on credences. We then consider ‘diachronic’ norms that are thought to constrain how credences should respond to evidence. We discuss some of the main lines of recent debate, and conclude with some prospects for future research.

This book illustrates the importance of semi-learned mythographic handbooks in the social, literary, and artistic world of Rome. One of the most intriguing features of these works is the fact that they all cite classical sources for the stories they tell, sources which are often forged.

Determining appropriate legal responses to the conduct of health care workers who endanger patients continues to provoke fierce debate. This is particularly true in the context of criminal law, which offers punishment as an obvious strategy. In the first of three papers which make up this issue's extended Health Care Law feature, Professor Alexander McCall Smith and Dr Alan Merry argue against the prosecution of health care workers except in circumstances where there is very dear evidence of a (...) culpable frame of mind. They do so against the backdrop of their description of proposed changes in New Zealand legislation on medical manslaughter. The catalyst for this change was a judge's refusal to countenance the prosecution of an anaesthetist for manslaughter for inadvertent error. In the authors' opinion the intervention by the New Zealand judge has given rise to a long overdue review of a harsh penal measure. However, in a commentary on McCall Smith and Merry's paper, Ron Paterson argues that all is not what it seems and that--in the light of New Zealand's 'no fault' system of compensation for medical accident--the present system should be maintained. We examine the role flexible working has for gender equality during the pandemic, focusing on arrangements that give workers control over when and where they work. We use a survey of dual-earning working parents in the United Kingdom during the peak of the first lockdown, namely, between mid-May and mid-June 2020. Results show that in most households in our survey, mothers were mainly responsible for housework and child care tasks both before and during the lockdown period, although this proportion has (...) slightly declined during the pandemic. In households where fathers worked from home during the pandemic, respondents were less likely to say that mothers were the ones solely or mostly responsible for housework and child care. Fathers who worked from home were more likely to say that they were doing more housework and child care during the lockdown period than they were before. Finally, we explore what we expect to happen in the postpandemic times in relation to flexible working and gender equality. The large expansion of flexible working we expect to happen may help reduce some of the gender inequalities that have exacerbated during the pandemic, but only if we reflect on and change our existing work cultures and gender norms. Now there are those today who would claim that any further discus sion of the latter half of this proposition, namely,Transcendence-Itse1f or God, is worthless and quite beside the point. Such persons would claim that the particular logia represented by the theological sciences has collapsed by virtue of its object having disappeared. Indeed, when one surveys the contemporary scene in philosophy and theology, there is a good deal of evidence that this is the case':"" theology of late having be come something of a "spectacle," to use Pritz Buri's term. Since 1945, there have been two waves of Anglo-American writing on Hegel's political thought. The first defended it against works portraying Hegel as an apologist of Prussian reaction and a theorist of totalitarian nationalism. The second presented Hegel as a civic humanist critic of liberalism in the tradition of Rousseau. The first suppressed elements of Hegel's thought that challenge liberalism's individualistic premises; the second downplayed Hegel's theism. This book recovers what was lost in each wave. It restores aspects of Hegel's (...) political thought unsettling to liberal beliefs, yet that lead to a state more liberal than Locke's and Kant's, which retain authoritarian elements. It also scrutinizes Hegel's claim to have justified theism to rational insight, hence to have made it conformable to Enlightenment standards of admissible public discourse. And it seeks to show how, for Hegel, the wholeness unique to divinity is realizable among humans without concession or compromise and what role philosophy must play in its final achievement. Despite the importance of engineering and technology in economic, social, and other aspects of our lives what it means to develop as an engineer, and how this is to occur, is not widely discussed. Becoming a Human Engineer explores the moral and ethical challenges of educating engineers through the philosophical lens of personalism, a branch of philosophy that puts the person first, seeing human growth and development as central to good. Building from the philosophy of the 20th century philosopher John (...) Macmurray, this book explores how ethics and education intersect through a continuous cycle of action and reflection. By pulling together disparate and wide-ranging topics across engineering education, several promising areas of future work are identified. Engineering methods and ways of reflection are deeply embedded in engineering education to the extent that they may interfere with becoming a person. A focus on specific knowledges must complement rather than distract from developing the habits of mind necessary for engineers to adapt to a changing world. Providing meaningful experiences and explicitly focusing on developing multiple ways to reflect on these experiences are shown to be critical for the holistic development of engineers as persons. Philosophy is a discipline characterized throughout its history by certain problems that seem to resist solution. How one is to begin a philosophical inquiry is one such problem. I examine this problem as it arises in Plato's Meno and Hegel's Phenomenology of Spirit. My thesis is that this problem, which suggests that there is no way to proceed, conceals within itself its own solution. There is no way to proceed because this problem marks the site where philosophical inquiry is to (...) flourish. I call this flourishing activity dialectics. ;In my exposition of Plato's Meno I endeavor to show that when read within the context of the dialogue Meno's presentation of the problem of inquiry, which means to stifle all inquiry, really is nothing more than a recollection of what Meno has just experienced. Not knowing that the true end of the discussion has been to reveal to Meno the nature of his own ignorance, Meno is unable to recognize this end when he comes to it. A philosophical inquiry is prevented from proceeding because its true task is to recollect what first remains concealed as the unfounded assumptions from which it begins. In this dissertation I attempt to elucidate such an understanding of inquiry. ;With my exposition of Hegel's Phenomenology of Spirit I observe that we readers begin with an unexplained and unexamined ability to attend to the dialectic of natural consciousness. I then attempt to explain why this need not beg questions about how one is to begin a philosophical inquiry. I contend that the true task of a philosophical inquiry is not to grasp the truth but to comprehend those truths that we already possess. Thus our task as readers is to comprehend this dialectic which guides our reading. My thesis is that the Phenomenology of Spirit is about the reader. It is our experience as readers along the path of the exposition that is recollected with the presentation of each natural consciousness in turn. The exposition comes to an end when we are able to recollect in Absolute Knowing the entire course of our own knowing. (shrink)
